COPYRIGHT
|
Copyright is a set of subjective legal rights that allows authors of literary, artistic, and scientific works, as well as authors of computer programs, to receive social (including material) benefits from the results of their creative activity.
Copyright protection lasts for the lifetime of the author and 70 years after his or her death. If the work was created in co-authorship copyright protection last during the lifetime of its authors and 70 years after the death of the last of them.
Copyrights are valid on the territory of countries that are members of the Berne Convention for the Protection of Literary and Artistic Works, which is valid in 181 countries of the world.
After the copyright protection period expires, the works become a part of the public domain. This means that anyone can freely use them without paying royalties to the author's descendants.
Copyright does not require any formal registration and exists from the moment the work is created. At the same time, it is possible to deposit works and the received certificate of copyright deposit is one of the pieces of evidence that can be used in case of disputes regarding the authorship of the work and/or the person who owns the property rights to it. In some countries such as the USA, copyright registration is essential for the rightsholder to be able to enforce their rights.
Furthermore, copyright registration is the easiest way to register rights to computer programs and databases.

In Ukraine, certificates of copyright registration (copyright deposit) are issued under the responsibility of the applicant. This means that the expert institution (UANIPIO – Ukrainian IP Office) carries out a formal examination of the compliance of the application materials with the requirements of the current legislation, namely, determines the date of application and checks the correctness of submitted documents. At the same time, the author can declare any date of creation of the work.
Third parties do not have free access to the deposited files and can read only the bibliographic data published by the applicant and the abstract.
